SC-ST Act in UP: कहा-अत्याचार की शिकायत को सरकार से पैसे की कमाई का जरिया बनाने का किसी को अधिकार नहीं है। यह टैक्स अदा करने वालों की गाढ़ी कमाई है।

SC-ST Act in UP: इलाहाबाद हाईकोर्ट ने एक अहम फैसला सुनाया है। हाईकोर्ट ने कहा है कि अगर एससी-एसटी एक्ट का आपराधिक केस समझौते के आधार पर समाप्त किया जाता है तो पीड़ित को सरकार से मिली आर्थिक मदद वापस करनी होगी। कोर्ट ने कहा कि अत्याचार की शिकायत को सरकार से पैसे की कमाई का जरिया बनाने का किसी को अधिकार नहीं है। यह टैक्स अदा करने वालों की गाढ़ी कमाई है।
हाईकोर्ट ने यह आदेश विभिन्न अदालतों से आई चार आपराधिक अपीलों की सुनवाई करते हुए दिया। कोर्ट ने पीड़ितों को 20 दिन में सरकार से मिली राशि समाज कल्याण विभाग के माध्यम से ट्रेजरी में जमा करने और सत्यापन कर अदालत को उचित आदेश पारित करने का निर्देश दिया है। यह आदेश जस्टिस राहुल चतुर्वेदी ने झब्बू दूबे उर्फ प्रदीप कुमार दूबे, विश्वनाथ यादव व अन्य, धर्मेंद्र उर्फ बउवा बाजपेई व अन्य, राकेश व अन्य की आपराधिक अपील पर सुनाया है।
अर्जी देकर केस समाप्त करने की मांग की थी
अपीलकर्तओं ने हाईकोर्ट में अर्जी देकर केस समाप्त करने की मांग की थी और अपनी अर्जी में कहा था कि पक्षों के बीच समझौता हो चुका है। पहला मामला ललितपुर के थाना जखौरा का है। जहां मारपीट की घटना को लेकर एससी-एसटी एक्ट का केस दर्ज कराया गया था। इसी तरह से अन्य मामले हैं। हाईकोर्ट ने अपने आदेश की प्रति सत्र अदालतों को भविष्य में इसका पालन करने के लिए भेजने का आदेश भी दिया है।
